Faithful followers will know that I was arrested for

writing my name on a bench with a magic marker

Subsequently after being arrested I was let go and attacked by a dog that jumped out of a moving vehicle and had to go to the hospital

The next day I received an e-mail from Sidhu Heera

the president of the Asbury Park Television.

For six years I have been doing a documentary on culture in

Asbury Park.  When Amy Quinn hired Hannah Walker as

media director I decided to test the politically correct

waters.

Sidhu jerked me around for five months then the morning after my arrest I receive an e-mail from him saying...

....apparently you have a bad reputation with

board members, therefore we will not show your

videos.

LET ME CLEARLY STATE HERE AND NOW THAT THIS IS

A POLITICALLY CORRECT VINDICTIVE VENDETA

BY A MAN HATING FEM NAZI MEMBER OF THE CITY

COUNCIL

....who has allowed her sexual orientation to

distort her judgment.

I allege that the same person who denied me is the same

person who orchestrated my false arrest.

Someone who has had dealings with her quote her as

saying......

....you hate me because I'm a lesbian...!!

She has a chip on her shoulder and is looking

for someone to knock it off.

I have made the statement that political correctness

suffocates freedom of expression.  This is proof.

All this is to cover up and draw attention away from

wrong doing on her part. It is an orchestrated false

arrest.  It would be used to deny me my performers permit

which is the objective all  along.

UPDATE

Robert Fernicola an attorney lives next to my daughter

in Loch Arbour.  I went for a consultation.  He decided

that he could pay for my defense with the proceeds

from the dog bite case.

As it turns out he made one phone call where he

discovered the woman did not have home owners insurance.

How do you get a mortgage without it?

Even though via e-mail he said he would file against her immediately, he never did

What he did do was assign an attorney named

David Gardinier to the case.

I plead not guilty.  Robert was supposed to attend the

hearing on the dog bite.  He did not show for either

hearing.

I had a conference with David Gardenier.  At that conference I requested he arraign a meeting with me and

the city attorney to see if we could reach an agreement

that would save a lot of time and trouble.

He said he would subpoena the city attorney.  That's

not what I meant. I thought he might know something

I didn't.

Anyway the first appearance in court happens.  He was

suppose to make some discovery motions.  As in who

were the board members who claim I have a bad

reputation.  Could they be the ones behind the

orchestrated false arrest?

Instead he informs me, that he doesn't want to do this.

Imagin' that.  Because his fiancée is friends with

the person I'm accusing of orchestrating my

false arrest.

Guess who is not getting any tonight unless they

co-operate?

I brought this to his supervisors attention.  He said

he would talk to him.  Sometime passed with

no response so I wrote again and very specifically

requested a meeting with the city attorney.

And said if your not going to do it you need to let me

know so I can pursue other directions.

I was ignored.  Never got a reply.

Fuckin' lawyers.  Don't respond to e-mails and

phone calls.

The next court appearance I show up only to be

told the case had been adjourned.

Adjourned.  Wha' da' fuck is dat?  Apparently

the lawyer had a conflict so he arraigned a postponement.

Nobody notified me.  Why not?  Could have

stayed in bed.

I am under the impression that this is my trial so the question is why wasn't I notified or consulted?

Who did he contact?  The court?  The court clerk?

The prosecutor? Was it by phone or e-mail?

Do I have a right to see that e-mail?

Even though I had told his supervisor that there was a conflict of interest to my surprise he was there for the next hearing.

He told me that the prosecutor wanted "some money"

and was willing to settle for a $250 dollar fine and

ten hours community service.

At no time did I authorize the attorney to negotiate

a settlement.  It was done completely with out

my knowledge or consent.

I told him that we had a conflict of interest.  He

withdrew and I applied for public defender. I

was assigned Ronald J. Tropolli.

CIRCADIAN RYTHMN

Is you natural sleep cycle.  I am a natural born night

person.  I was a night time cab driver for years.  I

often stay up till 4 AM.  Asking me to appear in

court at 7:30 AM is like asking them to show up at

4 AM.

I informed Mr. Tropolli of this.  The stress of

going to court at that early hour was impacting my health by aggravating my arthritic hip.  Apparently he wasn't listening because I was scheduled for 7:30 AM again.

I also again very specifically requested he arraign a meeting

with the city attorney.  He did not.

The day before my next court appearance I was in bed all day and called Mr. Tropolli's office to beg off.  He said I had to appear.  I rode to the court in pain on my bicycle. Mr. Tropolli allowed me to go home.

I e-mailed Mr. Tropolli the link to Oct 10, 2016

It wasn't long before he replied and said he was with drawing because he knew some people and had a conflict of interest.

He had transferred my case to Richard M Kiel the

alternate public defender. Please contact him.

It wasn't long before I received a hand scrawled note

from Mr. Kiel telling me he was my new attorney

and please contact him.

The last line said...dress appropriately for court

 and arrive early. 

He obviously thinks I'm a kid from the hood.  I'm 73 and have been in and out of courts for years.  This is my tenth trip to the Asbury court.  Nobody has ever mentioned

appropriate dress.  I don't need anybody telling me how

to dress.

....show up early.  Why?  Why do I even need to appear.

All he has to do is ask the judge for a continuance to familiarize himself with the case.

This was a bad sign.  Someone on a power trip who needs

to tell someone what to do.  Public defenders are usually

losers.

My suspicions were confirmed when I got him on the phone

on Fri May 5, 2017.

He was defensive and acted as a shadow prosecutor.

He had not reviewed the material I had sent Mr. Tropolli.

I ask for an e-mail.  He didn't have one and claimed to be technically illiterate.

 This seriously crippled my ability to defend myself because I was un-able to communicate with him.

Apparently he did have a computer and could get on line but did not have an e-mail.  He said he would have someone

review the material.

 

I told him this was my charge, my trial and I should

be able to direct my defense. If he didn't want to follow my

direction he could withdraw like Mr. Tropolli.  He refused

and said the court appointed him.  I better show up

for trial on the 12th or the judge could issue a warrant

for my arrest. Who's side are you on ?

He became defensive and pointed out that the supreme court said he could determine strategy.

If that's the case why don't ya'll get together with the

court and declare me guilty.

I asked why I had to show up at all?  All you need to do

is ask for a continuance so you can familiarize yourself

with the case.  I better show up or the judge can

throw me in jail.  This from the guy who is

suppose to defend you.

Some public defenders think advising you to plead guilty

is a defense.  You move, on they collect a fee, next please.

We agreed to talk again before he court date.

OVER KILL

The law gets entirely out of touch with reality sometimes.

This is over kill to the extreme

A simple name on a bench with a marker. Kiel thought I had spray painted something.  Where did he get that information?

It would have taken less than five mins. to sand it out

with a sander.  Ten mins. by hand and twenty mins. to paint it to look like the other boards.

Even though I offered to fix it the next day  on video I was ignored.

Why wasn't I given the opportunity to rectify the situation?

Eight months and three lawyers later a lot of time and energy could have been saved if the city of Asbury Park

wasn't on a witch hunt and the lawyer had arraigned a meeting with the city attorney as requested.

They are drunk on power and must be
